REAL ESTATE DISPUTES & LITIGATION

Our law practice focuses on transaction work to a great degree. It allows us, by client counseling, planning and drafting,  to create favorable documentation that provides the best legal protection possible should the need arise. No matter how much we plan, the future is uncertain and events may occur where a party breaches that well drafted agreement or disputes aspects of the agreement.

There is only one reason that we focus on counseling, planning and expertise in drafting real estate agreements. Why? We don’t know when or where an occasion will occur where a party breaches or when a real estate dispute will arise. We prepare for the absolute worst-case scenario to best prepare our client for that potential occasion. That is our philosophy as real estate attorneys at McFerran law. Our goal is to place the client in the best possible legal position if an occasion occurs in the future that leads to litigation of a dispute.

While we are excited to create real estate contracts that benefit our clients such as:

  • Real Estate Purchase and Sale Agreements
  • Commercial Lease Agreements
  • Purchase Agreements
  • Business Sale Agreements
  • Brokerage Agreements
  • Wills
  • Powers of Attorney
  • Deeds of Trust
  • Security Agreements

  • Easements
  • Real Estate Contracts
  • Licenses
  • Limited liability Companies
  • Corporations
  • Trusts
  • Deeds on Death
  • Promissory Notes
  • Settlement Agreements
We know that many agreements in the marketplace are not prepared by our real estate attorneys. Some are prepared by laypeople and others are prepared by legal counsel not accomplished in real estate matters. Problems may arise as a result.

We Have a Separate Group of Real Estate Dispute Attorneys

Many law firms today dabble in litigation, but do not really engage in it full time and aggressively. If you are reading this article because you are involved, or potentially involved, in a dispute either now in court or leading to litigation. You are seeking to hire an attorney. Please make sure that the attorney you hire and the firm actually does litigation.

You may be surprised that many attorneys and law firms handle a variety of matters, but when those matters become adversarial and court involvement will occur, they pass on such representation. It’s true. There are good reasons, but it is true.

You want an attorney and a law firm that lives, breathes and is in court constantly handling litigation matters. You want years of experience. Most of all you want a team of attorneys and other para-professionals working your matter exclusively.

Our litigation attorneys at McFerran law spend the vast majority of their time with clients involved with formal litigation. You want that. You want experience. You want time in the turf. You want (and deserve) aggressive representation. That’s why we have a separate department with attorneys focused solely on representing clients in formal litigation.

We Handle Real Estate Related Disputes & Litigation in All Court Systems

Our focus is the State of Washington. We are admitted in all the counties of the State of Washington as well as members of the federal court system. We handle cases in:

  • Local city municipal courts
  • Local County District Courts
  • Statewide Courts of Appeal
  • Statewide federal division courts
  • Statewide mediations
  • Statewide arbitrations
  • Statewide County Superior Courts
  • State of Washington Supreme Court
  • Statewide federal bankruptcy courts

Our Real Estate Dispute & Trial Litigation Experience

Our past trial experience includes jury trials, bench trials (where the judge decides the case), mediations and arbitrations. We have extensive experience in all the various venues (locations for litigation) and are very confident in each location.

Trial and litigation work is more than just the facts and the law. It is about presenting the facts and the law in the best manner possible. Many attorneys (frankly most attorneys both senior and junior) do not have significant experience at trial and, therefore, never get the opportunity to develop and refine those skills and to become comfortable with the trial process as a whole. Most attorneys are scared to death to go to trial. This is why it is so important that you make the proper choice of hiring a litigation attorney.

Representation in a mediation is not anything like a trial. Many (or most) attorneys can handle that. However, mediation representation by a trial attorney is a very different skill set. As a result, if you are reading this article and you are already involved in litigation and have hired an attorney, our litigation attorneys may still assist.

McFerran Law litigation practice group offers trial representation as a service to new clients and cooperating attorneys. Our attorneys may substitute and associate into existing cases moving toward trial to help and assist other attorneys or clients who may not be prepared to try their case or who are uncomfortable themselves taking their case to trial.

By bringing our litigators into a case before trial, we can offer you a new face on the existing case; can ready the case for trial, all while injecting new energy and momentum that may have become stale over the months and even years that it takes to finally get your case to trial.
